These terms apply to the WaveCheck app, created by Austin Urraca as a Freemium service. By downloading, installing, or using WaveCheck, you agree to be bound by these terms. If you don't agree, please don't use the app.
Use of the App
WaveCheck is provided "AS IS" without warranties of any kind. You agree to use the app only for lawful purposes and not to:
- Reverse engineer, decompile, or extract source code from the app
- Copy, modify, or create derivative works of the app or its content
- Use the app to harass, abuse, or impersonate other users
- Attempt to gain unauthorized access to our servers or other users' accounts
- Use automated systems (bots, scrapers) to access the app or its data
All intellectual property rights in the app, including its design, forecasts methodology, source code, and trademarks, remain with the developer.
Accounts & User Content
You may need to create an account to use some features. You're responsible for maintaining the security of your account credentials and for all activity that happens under your account. Notify us immediately at support@wavecheck.surf if you suspect unauthorized access.
When you log surf sessions, post photos, or share other content in WaveCheck, you keep ownership of that content. By posting, you grant WaveCheck a non-exclusive, worldwide, royalty-free license to display and distribute that content within the app to provide its features (for example, showing your session in a spot's feed). We don't sell your content to third parties.
You can delete your sessions or your entire account at any time from the app's settings.
Subscriptions
WaveCheck Pro is available as a monthly subscription or annual subscription.
- Auto-Renewal Disclosure. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the price stated at the time of purchase. You can manage and cancel your subscriptions by going to your account settings on the App Store (iOS) or Google Play Store (Android) after purchase. Uninstalling the app does not cancel your subscription.
- Pricing. Current pricing is $2.99/month or $24.99/year. Prices may vary by region and are displayed in your local currency at the time of purchase.
- Refunds. Refund requests are handled by Apple (reportaproblem.apple.com) or Google Play. We do not process refunds directly.
- Donations. WaveCheck pledges to donate 20% of net subscription revenue to the Surfrider Foundation. "Net" means revenue after Apple and Google take their standard commission (15-30%). Donations are made annually with records available upon request.

Surfing involves risk
WaveCheck forecasts are estimates based on third-party weather and ocean data. Conditions can change quickly and dramatically. Forecasts can be wrong.
Surfing is an activity with inherent risks including drowning, injury, and death. Hazards include but are not limited to large waves, currents, rocks, reef, marine life, other surfers, and offshore conditions.
Always exercise your own judgment. Check local conditions in person, surf within your ability, never surf alone if conditions are challenging, and follow local rules and lifeguard guidance. WaveCheck is a planning tool, not a substitute for experience, training, or first-hand observation of the spot.
Liability
We rely on third parties for forecast data and accept no liability for losses arising from your reliance on the information presented in the app. To the maximum extent permitted by law, WaveCheck and its developer are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the app, including but not limited to injuries sustained while surfing, missed surf sessions, or any decisions made based on forecast data.
The app is provided "AS IS" without warranties of merchantability, fitness for a particular purpose, or non-infringement. We make no guarantee that the app will be available without interruption, free from errors, or that forecasts will be accurate.

Updates & Termination
We may update, change, or discontinue WaveCheck or any of its features at any time, with or without notice. We may also suspend or terminate your access to the app if you violate these terms.
Upon termination, your rights and licenses under these terms end. Any provisions intended to survive termination — including liability limitations, intellectual property ownership, and governing law — continue to apply.
Changes to These Terms
We may update these terms from time to time. When we make material changes, we'll update the effective date at the top of this page. If the changes are significant, we'll notify you via the app or by email where reasonable. Continuing to use WaveCheck after changes take effect means you accept the updated terms.
Governing Law
These terms are governed by the laws of Portugal, without regard to conflict-of-law principles. Any disputes arising from these terms or your use of the app will be resolved in the courts of Portugal, unless your local consumer protection laws require otherwise. Where permitted by local law, we may agree with you to resolve disputes through mediation before pursuing court action.
